These Terms & Conditions ("Terms") govern your participation in the Pocket Radar Data Capture Program (the "Program"). By submitting any video to the Program, you ("you," "Participant") agree to be bound by these Terms. If you do not agree, do not participate.
The Program is a skill-based contest, not a game of chance. No purchase is necessary to participate beyond use of the Pocket Radar app and the Pocket Radar Smart Coach radar.
1. Definitions
· "Approved Video" means a pitching video you submit that Pocket Radar accepts after review against its submission standards. Pocket Radar determines, in its sole discretion, whether a video is approved. Videos that are rejected do not count toward any reward threshold.
· "Submitting Account" means the Pocket Radar account used to submit the videos.
· "Hardware Reward" means a Pocket Radar Smart Display or Smart Coach device, as selected by an eligible participant.
· "Plus Reward" means three (3) months of a Pocket Radar Plus subscription.
2. Eligibility
To participate, you must:
1. Be 18 years of age or older at the time of submission.
2. Be a legal resident of the United States and have a valid U.S. shipping address (no PO boxes).
3. Ensure that every person who appears or pitches in a submitted video is also 18 years of age or older and has consented to appear in the video and to the use of their video and likeness as described in these Terms.
4. Use a single Pocket Radar account. Creating or using multiple accounts to submit videos or qualify for rewards is prohibited and will result in disqualification.
5. Have an account in good standing and not be in violation of Pocket Radar's app Terms of Service or Privacy Policy.
Employees, contractors, and immediate family members of Pocket Radar, and anyone otherwise involved in administering the Program, are not eligible to win rewards.
Pocket Radar reserves the right to verify your eligibility at any time and to disqualify any Participant who does not meet these requirements.
3. Video Submission and License Grant
1. Grant of rights. By submitting a video, you grant Pocket Radar a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, store, modify, analyze, and create derivative works from your submitted videos for any purpose, including but not limited to product development, research, and the development, training, and improvement of computer vision and other machine learning models and products.
2. Your representations. You represent and warrant that: (a) you own or control all rights necessary to submit each video and grant the license above; (b) every individual appearing in the video is 18 or older and has consented to the recording and to Pocket Radar's use of the video and their likeness; and (c) the video is your original, authentic recording and does not contain manipulated, artificially generated, or third-party footage; (d) The Submission does not infringe upon or violate the intellectual property rights, privacy rights, publicity rights, contractual rights, or any other rights of any third party.
3. Approval is at Pocket Radar's sole discretion. Pocket Radar may accept or reject any video for any reason. Only Approved Videos count toward reward thresholds.
4. By submitting a Video, you acknowledge and agree that your submission is final and may not be modified, replaced, or withdrawn after it has been received by the Company, except where required by applicable law. This applies to all submitted videos, including videos submitted by Participants who do not become one of the first 40 qualifying users.
4. Hardware Reward — First 40 Users to 250+ Approved Videos
1. The first forty (40) Participants to reach 250 or more Approved Videos are eligible to receive one (1) Hardware Reward. Qualification is determined by the timestamp at which a Participant's 250th video receives approval.
2. Each qualifying Participant will be notified by email at the address associated with their Submitting Account ("Winning Email"). The Winning Email will ask the Participant to (a) choose their reward (accessory), and (b) provide a valid U.S. shipping address (no PO boxes).
3. You must respond to the Winning Email within 48 hours of the time it is sent. If you do not respond within 48 hours with your reward selection and a valid U.S. shipping address, you forfeit the Hardware Reward, and the next qualified Participant (by approval timestamp) will be offered the reward in your place.
4. It is your responsibility to maintain a valid, monitored email address on your Submitting Account and to check spam/junk folders. Pocket Radar is not responsible for undeliverable, missed, or filtered emails.
5. Hardware Rewards are limited to one (1) per Participant and to a total of forty (40) across the Program. If fewer than 40 Participants reach the threshold, only the qualifying Participants will receive a Hardware Reward.
6. In the event two or more Participants reach 250 Approved Videos at the same recorded time, the Participant whose account was created earlier / who submitted their first video earlier will be ranked ahead.
5. Plus Subscription Reward — 50+ Approved Videos
1. Any Participant who reaches 50 or more Approved Videos will receive a Plus Reward (3 months of Pocket Radar Plus).
2. The Plus Reward is applied to the Submitting Account that submitted the qualifying videos. The Plus Reward is non-transferable and cannot be moved, gifted, or applied to any other account.
3. If the Submitting Account does not have an active paid subscription, the 3 months of Plus will be applied to the account upon qualification.
4. If the Submitting Account already has an active paid subscription, the 3 months of Plus will be added to the account and will begin after the current paid subscription period ends.
5. The Plus Reward is limited to one (1) per account for the duration of the Program. [If the account cancels or deletes during the 3-month Plus period, the remaining time is forfeited and is not refundable, transferable, or extendable.] [At the end of the free 3-month Plus period, the subscription will not auto-renew into a paid plan unless you separately choose to subscribe. — confirm and adjust to match your billing behavior.]
6. General Reward Terms
1. Awards are awarded solely to the selected Participant and may not be transferred, assigned, sold, pledged, exchanged, or redeemed for cash. Any attempted transfer or assignment is void. No substitutions or cash equivalents are permitted.
2. Pocket Radar reserves the right to substitute a reward of equal or greater value if the stated reward becomes unavailable.
3. Hardware Rewards ship to U.S. addresses only.
4. Rewards are issued only to Participants who satisfy all eligibility and submission requirements and who have not been disqualified.
7. Account Deletion or Withdrawal
If you delete your account, leave the Program, or your account is terminated at any point, all of your Program progress — including any submitted videos counted toward a reward threshold and any unredeemed rewards — will be permanently lost. This cannot be reversed or restored. Videos already submitted remain subject to the license granted in Section 3 and cannot be unsubmitted.
8. Disqualification and Fraud
Pocket Radar may disqualify any Participant and void any submission or reward, at its sole discretion, if it believes the Participant has:
· created or used multiple accounts;
· submitted manipulated, artificially generated, duplicated, or non-original videos;
· submitted videos featuring individuals under 18 or without proper consent;
· attempted to manipulate the submission, approval, or reward process; or
· otherwise violated these Terms or acted fraudulently or in bad faith.
9. Program Changes, Suspension, and Termination
Pocket Radar reserves the right to modify, suspend, or terminate the Program, or to change these Terms, at any time and for any reason, including changing reward thresholds, reward types, or eligibility, to the extent permitted by law. Material changes will be posted on this page. Your continued participation after changes are posted constitutes acceptance of the updated Terms.
10. Privacy
Videos and information you submit are handled in accordance with the Pocket Radar Privacy Policy, available here.
Please review it to understand how your data is collected, used, and stored.
11. Disclaimers and Limitation of Liability
The Program is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Pocket Radar is not liable for any indirect, incidental, special, or consequential damages arising out of or related to your participation in the Program or any reward. Pocket Radar's total liability relating to the Program will not exceed the value of the reward at issue.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California.
13. General
These Terms are the entire agreement between you and Pocket Radar regarding the Program. If any provision is found unenforceable, the remaining provisions remain in effect. Pocket Radar's failure to enforce any provision is not a waiver of that provision.
